Terms of Service and Acceptable Use Policy

Our customers are expected to use our service with respect, courtesy, and responsibility, giving due regard to the rights of others. Common sense is the best guide as to what is considered acceptable use.

The following are unacceptable uses:

  • Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted material, violation of U.S. export restrictions, fraud, trafficking in obscene material, or any other illegal activity.
  • Abuse of our service, including but not limited to commercial solicitation, harassment, trolling (posting outrageous messages to generate indignant responses), uploading photos or videos that contain nudity, uploading or posting of other offensive content, or naming celebrities or public figures as guests of honor, unless such persons are personal friends of the party host. We reserve the right to determine what constitutes abuse.
  • Conduct giving rise to potential civil liability, including but not limited to posting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Usurprise reserves the right to limit or eliminate any or all of its services at any time. For example, Usurprise may limit the number of guests to whom invitations are sent, if in our sole opinion the number of invitations sent or other characteristics of the invitations indicates potential misuse.

Posting or uploading information to our servers does not affect ownership of such information.

Because Usurprise is automated and because it would be impossible to recognize all abuse or infringing material, Usurprise disclaims all responsibility for any abusive or infringing material that may be posted to its sites or sent out by means of its servers, other than its responsibilities as a service provider pursuant to the Digital Millennium Copyright Act. Notices of allegedly infringing material on our servers may be sent to dmca@Usurprise.com, specifying in reasonable detail what material is allegedly infringing of what, whether you are the owner of the copyrighted material or the representative of such owner, and your statement that the information you are providing in your notice to us is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Warranties and limitations thereof: Because Usurprise is a free service, it is provided on an AS-IS basis, and your use of our site is at your sole risk, except that Usurprise warrants that it will use information disclosed to us by our customers only as set forth in our privacy policy. THE FULLEST EXTENT PERMITTED BY LAW, USURPRISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH OUR WEBSITE AND THE SERVICES WE PROVIDE. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT, AND ASSUME NO LIABILITY OR RESPONSIBILITY OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE OR OUR SERVICES AND/OR ANY PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF OUR WEBSITE OR OUR SERVICES.

Limitation of Liability

IN NO EVENT SHALL USURPRISE, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM YOUR USE OF OUR WEBSITE OR OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Your sole remedy in case of a breach of warranty regarding our use of information is our prompt and best efforts to take corrective action.

Miscellaneous: This agreement is the entire understanding between the parties on this subject matter, and it may be amended only in writing. Its legality and interpretation shall be governed by laws of the State of Florida.

Privacy Policy

Usurprise is a web-based forum through which visitors can host virtual surprise parties. As such, Usurprise collects and uses the information provided to us as follows:

1. THE INFORMATION WE COLLECT:

Party hosts may be asked to provide the following information:

  • Their own first and last names
  • Their email address
  • Their time zone
  • Type of celebration
  • Identity of the Guest of Honor
  • Email address of the Guest of Honor.
  • Names and email addresses of invited guests . (The Host has access to all such information, and can remove any information uploaded by an invited guest, or even un-invite an invited guest. )
  • Host's Photo or video
  • Personal message
  • Such other information as we may request or as they choose to provide.

Invited guests do not have to provide information, but if they choose to, they may provide the following:

  • Their names
  • Uploaded photos or videos.
  • In some cases, they may invite other guests.
  • Such other information as we may request or as they choose to provide.

We collect other information as well:

  • IP addresses of those who access our servers
  • Basic technical information regarding the equipment and software of those who access our servers.
  • Basic site-related tracking information via cookies.
  • To the extent we offer credit-card-based purchases of goods or services, we will collect such information as is necessary for such purchases.

2. WHAT WE DO WITH THE INFORMATION WE COLLECT

We use it to provide our services; to track what portions of our website(s) are frequented and when, to give us a better idea of how people are using our site(s) so that we can improve them; and to conduct commercial and consumer transactions. In general, we will only use the information you provide to us for the purpose for which such information was provided. We may also use this information to deliver to you information about our company and promotional material. Your information may also be used to contact you when necessary. Users may opt-out of receiving future mailings from Usurprise by following the instructions set forth in the opt-out section of our web site. Non-personal demographic and profile data is used to tailor your experience at our site. This information may also be shared with advertisers on an aggregate non-personal basis. We may save such information for up to two years.

3. PRIVACY RIGHTS OF PERSONS ABOUT WHOM WE COLLECT INFORMATION

Invited guests
  • need not provide any information.
  • will not see the email addresses of other invited guests.

Guests of honor
  • will receive an email containing a link to Usurprise where he/she can access the celebration and retrieve the greeting card.
  • will see the names, but not see the email addresses, of the invited guests.

Both invited guests and guests of honor can request that their information be removed by contacting Usurprise at removeme@usurprise.com. We will promptly remove such information after sending a confirmation email and receiving a confirming response. Usurprise will not use such removed information for any purpose, although it will be archived along with all other information on our servers. Usurprise will not disclose such removed information to anyone unless ordered to do so as part of a legal proceeding. Usurprise will be inclined to resist such an order but does not guarantee that it will do so.

We reserve the right to change this privacy policy without notice, but changes will not apply to information already gathered unless such changes provide at least the same level of privacy protection as was provided before such changes.
